Question #1:
In A Civil Case, Can I Be Arrested If I Lose Or Fail To Appear In Court?
I randomly found a plaintiff is suing me for money allegedly owed. I went on the County Court website and found the case to be pending, and a few charges up (Breach of contract/warranty). I can counter but would rather file BK actually, as I have medical bills and other unknown hits and charges on my credit report. The plaintiff is asking for $10k, not more than $25k. I have incriminating emails sent by the plaintiff, pictures etc, but casting all that aside for now, if I don't show up (money issues etc, work outta state maybe or illness), can I be arrested if I lose or don't show up? As I am often out of State or even the country.
What does a judgment do, if I was to lose by default for not showing up etc? This is in California by the way.
Thank you all in advance.
I do have an attorney now.
I could go two ways with this. BK or fight it.
I was just not sure, what the legal implications were, if I was to never get served, if I was outta State etc.
Thanks all!
Actually smart mouth (Dan), I did randomly find this. Ok, I searched randomly, then found it. I have never been arrested, I don't have a criminal record, and don't need this on it either.
Thanks.
IF I file Bankrupt before I am subpoenaed, called to court etc; will I even need or have to appear?
IF I file Bankrupt before I am subpoenaed, called to court etc; will I even need or have to appear?
Question #2:
If I pay a charge-off on my credit report will my score go up?
I recently called a company I owed $36 to, they would not agree to a pay-for-delete no matter how much sweet talking I tried to convince them with. So, I decided to pay anyways. They are sending me a letter and notifying the 3 credit bureaus that the account is paid. Will my score go up? I only need it to go up a few points!Question #3:
If I don't charge anything on my credit card, can I still get charged?
If I have reported monthly balance of $0, will the bank report me as delinquent on the account if I don't pay anything? How will this affect my credit score?Question #4:
Should I dispute small items on my credit report?
I had a friend of mine tell me that if the charge-offs were small (I have two ranging from $30 & $60) that usually when disputing it the companies won't even bother for such a small amount and the negatives will be removed from my account within 30 days. Does this sound like something I should try? And lastly, but MOST IMPORTANTLY: if the credit bureau finds the debt to be valid after a dispute will it lower my credit score?Question #5:
I have a credit score of 450 and trying to buy a house. My lender will not give me a loan to purchase a home?
because my credit score and report has not been updated and its been over a six months. I have every receipt from each creditor showing my balances are paid in full. Why cant the lender just accept the receipts as proof of all debt being paid in full. Even though the report still has not been updatedQuestion #6:
Chase Credit Card trying to screw me help!?
Ok I recently received word from Chase that they were lowering my Credit limit on my card because of "severe late payment." However, I downloaded my history from their site and every single month there is record of my automatic payment being made ON TIME! Now it was only about the minimum payment but it was still being paid and on time. They added hidden fees like protection plans which keep adding up each month on there too which basically cancel out my payments.
I have sent them several messages with the downloaded activity attached. I dont care about the credit limit going down because I am not using the card anymore but I dont want LATE PAYMENTS on my credit report when I made the EVERY payment on time.
Help is appreciated.
Question #7:
Why is govt & business under reporting the true unemployment and the Federal tax base?
U.S. Dept of labor says there is 236 million Americans available to work.76 million NOT available to work, combined 310 million citizens.
The 2009 business & individual combined IRS filings around 140 million. 236-140=94 million.
Half of the 2009 IRS filings were low enough to have no Federal Tax liability after people claimed all their deductions, exemptions, credits etc. Nearly 70 million of tax filers end up with very low incomes.
This means the federal govt IS NOT operating or depending solely on income tax collection, plus lie about their means of appropriations to hand out money world-wide,nation-wide to the wealthy under Trickle-around never down wealth economics.
It's a total joke when any politician claims they will create jobs especially in the huge numbers needed.
So you let either side claim they have the answers when in fact their not willing to come clean on the reality of where we are now & why.
Question #8:
Promissory Note Foreclosure?
I have a first and second mortgage on my property. We are about 100K under water. Bank has denied us (Chase) twice for a loan modification and they have paid the last 2 tax payments. We can not longer afford payments wife's job.My question is my wife did not sign either Promissory Note I am the only signor. She did not sign second mortgage. She signed first. If we go to foreclosure which looks possible will Chase come after her for the first mortgage? Since she is not on the PN will the foreclosure only impact my credit she is not on either loan and does not currently appear on her credit report.
Is Chapter 7 better than Foreclosure in my case and just walk away?
Question #9:
What's the soundtrack to the Battle Report on Kingdom Hearts 2?
When you get to the battle report on Kingdom Hearts 2, there's this really nice piano melody, and I would love to know what it's called. I'd rather not go through the entire final boss fight, all the videos AND the credits just to listen to it, haha!So yeah, if anyone can help me out here, it'll be a huge help :)
Question #10:
How can I contact the credit bureaus?
I ordered my yearly credit reports a couple of months ago but they never arrived so I don't know if they went to a wrong or old address since it only asks for your zip code. When I try calling the credit bureau it asks for the credit report number I don't have since I didn't get the reports otherwise won't transfer me to an operator for help. Does anyone know a way around this so I can get through for help? I had ordered it from Annualcreditreport and it only asked for my name, zip code and social not an actual street address and when I try to order it again it says I already have but it never came to me and they don't have customer service either, just a "suggestion box" I filled out several weeks ago with no response.Question #11:
Does my installment payment balance not getting updated as payments are made effect my credit score?
I just received a copy of my credit report and I am a bit concerned with what is on it. I have been making on time car payments for the past 23 months (all show up) and only have 1 payment to go until it is 100% paid off and I get the title.I am a bit confused because I only owe the 1 month but the credit report shows that I still owe the entire balance although it says it's been paid on time.
Does this effect my credit score because the auto finance company hasn't reduced my balance when indeed I have made payments and the report still shows that my balance is the full amount of the loan?
Equifax has two columns on the report, balance and credit limit. Both show the same amount. Shouldn't balance only show the $200 I owe and not the whole amount?
Question #12:
where can i check my credit rating/report for free?
hiya please help i need to check my credit rating i need a loan n need to know why im getting rejected as i always thoughtn i had a good credit rating? xany online sites i can check on?
Question #13:
Home & Auto Insurance Rip-Off?
My home & Auto insurance has doubled thisyear. I called today to ask why as I had no claims or tickets. The reason I was told was the new way that rates are based. My agent said that your credit score is now used in the calculation of your rate. With one credit card that I pay off in full monthly and never a late payment nor any outstanding debt i would think I should have scored high on my credit report. I feel by being fiscally responsible I am being ripped off by the insurance companies by this foolish way of rating policies. are their any other insuance companies that still rate you the old fashioned way by your record?Question #14:
Question about scam job offer?
Hi, a few days ago I received an email from s.fisher@hiringstaff.net to let me know that I'm in process of starting the job but they need some information about my credit score. That's the email:Hello,
We have reviewed your application, and would like to move onto the next step of our employment process. Recently, the distribution center was fined for having illegal workers. Therefore, they are asking us to prescreen all possible candidates to prevent this from happening again. We are asking all candidates to submit a current copy of your credit score to go into your employment file.
Your credit report/score will not matter, as it's rather an easy means of verifying your identity and valid citizenship in the US. Below will be a link to obtain your credit score for $1, and once done so, we will be noticed and process you for an in person interview. We are hiring 6 workers, but please act promptly, or the job might be taken. You will need to bring 2 forms of identification with you to the interview.
Your score can be obtained here: Click Here
We appreciate cooperation, and hope to see you for your interview soon.

They do not understand i have other bills which are starting to be behind starting this month

Question #17:
School is going really badly right now? What am I doing wrong?
I am taking all honors and an AP class and we are a month and one week in. I have an A in math, language arts, world history AP, spanish 2, and advanced Architecture, but I have an F in my honors chem class! Straight A's and and F!When i checked the progress report it says I got a 89% on the only test we took, and a 92% and a 94% on the 2 quizzes we took. I do ALL my homework and labs. When i talked to my teacher about it, he said it was not a mistake and that my work was not efficient enough for him and my language and vocabulary was not sophisticated enough so he did not give me any credit for it. And on my labs (2 of them) both are worth 300 points [tests are 100] and he gave me 22 points on one and 112 on the other! I can't do it! I don't know how to fix it! I spend a lot of time on his homework now! About 3 to 4 hours everyday and now we have a research report due. we need 90 pages of research! and 20 pages of the actual report. I've gotten used to staying up 2 days in a row trying to finish, just to not recieve any fricken credit! I hate him!
Apparently, the highest grade in the class right now is a C+. I've never wished I had a C before but now i do.
Question #18:
Please review this and let me know what you think? :)?
I am applying for my first Studio, its a low income housing complex that has a very intense screening process. They pull your credit report and it has to be at 650 or higher (Im at like 653 w/ Experian- but I dont know what bureau they use that might make my score a little lower. A coworker has suggested turning in a friendly statement of facts along w/ a copy of my experian report explaining any points they may possibly view as negative. Please read the below and let me know if you think its too much? Its okay? Any advice much appreciated!
********************************************************
This is my personal statement regarding any possible negative points of my credit report in further detail.
Possible Negative Point 1- Large amount of money owed in total:
This is for one reason only and that is my student loan amount. I attend a private nursing school and have needed to take out a US Dept of Education loan on the tuition cost. I have been paying back interest that may be building up here and there, but the large amount of money I owe is due entirely to student loans. These are government funded loans and I am not scheduled to begin paying these back until 6 months after my graduation date.
My auto loan remaing balance is under $1000, and per my credit report you can see that it will be paid off in full with 3 more months of regular payments.
Possible Negative Point 2- Low Credit Limit on Revolving Credit Card, and amount owed closer to the total limit:
I recently had a emergency large ticket item on my vehicle and had to turn to my credit card to help pay for the repair. Per my credit report you should see that I have only been over the limit once by error but have maintained this credit card in good standing and most often with very low balances since I received it when I turned 18 in 2006.
Things I would like to be considered:
I am 22 years old and am currently bulding my credit. I have never taken on a financial responsibility I wasn't able to handle and my credit report should reflect that as well. I had a $9,000 car loan that I obtained in May 2008 set to last for 4 years. Through timely payments and extra payments I will be done with this loan much ahead of schedule by the end of 2010.
I have also attached a copy of my Experian Credit Report in full detail as I obtain those free with a monthly subscription in case your source of credit reports don't provide enough detail to support my facts above.
I appreciate you taking time reviewing my statement. I would very much like to be approved for this apartment and therefore felt the need to point out the reasons for any possible negative point of my credit report in further detail.

Question #19:
This promises to be the worst labor day...?
THIS promises to be the worst Labor Day in the memory of most Americans. Organized labor is down to about 7 percent of the private work force. Members of non-organized labor — most of the rest of us — are unemployed, underemployed or underwater. The Labor Department reported on Friday that just 67,000 new private-sector jobs were created in August, while at least 125,000 are needed to keep up with the growth of the potential work force. The national economy isn’t escaping the gravitational pull of the Great Recession. None of the standard booster rockets are working: near-zero short-term interest rates from the Fed, almost record-low borrowing costs in the bond market, a giant stimulus package and tax credits for small businesses that hire the long-term unemployed have all failed to do enough.
That’s because the real problem has to do with the structure of the economy, not the business cycle. No booster rocket can work unless consumers are able, at some point, to keep the economy moving on their own. But consumers no longer have the purchasing power to buy the goods and services they produce as workers; for some time now, their means haven’t kept up with what the growing economy could and should have been able to provide them.
This crisis began decades ago when a new wave of technology — things like satellite communications, container ships, computers and eventually the Internet — made it cheaper for American employers to use low-wage labor abroad or labor-replacing software here at home than to continue paying the typical worker a middle-class wage. Even though the American economy kept growing, hourly wages flattened. The median male worker earns less today, adjusted for inflation, than he did 30 years ago.
But for years American families kept spending as if their incomes were keeping pace with overall economic growth. And their spending fueled continued growth. How did families manage this trick? First, women streamed into the paid work force. By the late 1990s, more than 60 percent of mothers with young children worked outside the home (in 1966, only 24 percent did).
Second, everyone put in more hours. What families didn’t receive in wage increases they made up for in work increases. By the mid-2000s, the typical male worker was putting in roughly 100 hours more each year than two decades before, and the typical female worker about 200 hours more.
When American families couldn’t squeeze any more income out of these two coping mechanisms, they embarked on a third: going ever deeper into debt. This seemed painless — as long as home prices were soaring. From 2002 to 2007, American households extracted $2.3 trillion from their homes.
Eventually, of course, the debt bubble burst — and with it, the last coping mechanism. Now we’re left to deal with the underlying problem that we’ve avoided for decades. Even if nearly everyone was employed, the vast middle class still wouldn’t have enough money to buy what the economy is capable of producing.
Where have all the economic gains gone? Mostly to the top. The economists Emmanuel Saez and Thomas Piketty examined tax returns from 1913 to 2008. They discovered an interesting pattern. In the late 1970s, the richest 1 percent of American families took in about 9 percent of the nation’s total income; by 2007, the top 1 percent took in 23.5 percent of total income.
It’s no coincidence that the last time income was this concentrated was in 1928. I do not mean to suggest that such astonishing consolidations of income at the top directly cause sharp economic declines. The connection is more subtle.
The rich spend a much smaller proportion of their incomes than the rest of us. So when they get a disproportionate share of total income, the economy is robbed of the demand it needs to keep growing and creating jobs.
What’s more, the rich don’t necessarily invest their earnings and savings in the American economy; they send them anywhere around the globe where they’ll summon the highest returns — sometimes that’s here, but often it’s the Cayman Islands, China or elsewhere. The rich also put their money into assets most likely to attract other big investors (commodities, stocks, dot-coms or real estate), which can become wildly inflated as a result.
